Legal Question in Insurance Law in Ohio

I was rearended by someone, they provided their insurance and they were not the owner of the car. That persons insurance is now refusing to pay until the owner of the car returns their phone calls, to let them know if they had insurance or not. I don't know who the owner of the car is and have no way of finding out. The insurance co. says, ''they have called and have not gotten any responses from the owner.'' What is my next step and can I sue all of them at once or do I have to do it all seperately?''

You can't sue them separtely. They must be joined as parties to the same lawsuit. It is possible to win the amount for damages to your car, lost wages, medical bills, pain and suffering and other incidentals. If you are interested, I would probably take this case on a contingency basis, which means my fees are a part of the amount we win in Court (no cost to you, my fees come out as a percentage of the award).
