return of health insurance monthly premiums

i am an independant contractor as a driver with roberts express. i am enrolled in their group health insurance with john alden life insurance company. in 1997 june, i turned age 65. i was not aware that i am not eligible to receive health insurance benefits from insurance company, if i am medicare eligible nor insurance company notified me of material change in the coverage. i kept paying monthly premiums till april 98 for me and my wife. i never used the health insurance but my wife used it once for mammogram. do i have recourse to recover my premiums which amounts to about $ 5000?

It sure would not hurt to explain the situation and request a refund. If they agree to provide a refund, they will probably want to deduct the amounts paid for any claim during this period. If they refuse or neglect to respond to your request, contact your state's Insurance Department or Insurance Commissioner's office.
