Uninsured motorists insurance liability

I was invloved in a motorcycle accident. The other driver was cited. He does not have insurance. My Harley has been totaled by my insurance co through the uninsured motorsist policy I have. I do not want it totaled. The insrance co. would save $2800.00 by paying the repair cost. Do I have to accept their totaling of the bike? And is uninsured motorists insurance responsible for my lost wages? I suffered a broken left toe and two bones broke in my right foot and have been off work for a month.

You might try asking your insurance company to allow you to keep the motorcycle, and they will deduct the "salvage value" from what they pay you in damages.

As for payment of your own pain & suffering and lost wages, it depends on the language of your policy - but, in general, if you have uninsured motorist coverage, your company is liable to pay you what the negligent person would be responsible for (medical expense, pain & suffering, lost income, permanent injury, etc.), if you filed a claim or lawsuit.
