Domain Names related to Company Names

What are the laws concerning the use of a domain name that is the same as the company name?

We purchased a company called TufTek which makes a product that we enhanced and now market. The domain name, TufTek (dot) com was lost in the shuffle, expired and was purchased by a company that claims to be an ''Internet Domain Holding Company.''

Do we have any rights to that domain name, especially in light of the fact that it expired and was purchased?

You should get a lawyer to contact the other company to get the domain assigned to your company, assuming they have no legitimate rights in the name.

1) Trademark registration pre-empts domain name registration. The domain name was lost / acquired by another company. Your only remedy would be to a obtain trademark registration. A preliminary search of the Trademark Office Records indicates that the terms or marks, TufTek, and/or TufTek.com, have not been registered or applied for.
