Whenever a photographer takes a picture a common law copyright is established. However to enforce those rights the photographer must show actual damages. If the photographer has filed for a statutory copyright that he can get legal damages of up to 5000 dollars plus attorneys fees for each violation. If the photographer copyrighted the pictures in his own name then the fact that he went out of business will not affect his ability to enforce the copyright.
