How do you go about obtaining the exclusive use of a specific name on a national level?

1. You make sure you are using the name in commerce between the states (Canada is NOT a state; New York, Massachusetts, Pennsylvania, Illinois and Iowa are states) as an identifier of the unique source of goods/services.

2. You make sure that the name you have chosen does not infringe anyone else's trademark or service mark.

3. You apply to the US Patent and Trademark Office for trademark registration.

That you are in Ohio and I am in New York makes little difference except that it is less likely that we would meet face-to-face, but for trademark registration work the client generally does not actually need to lay eyes on the lawyer.
