Legal Question in Juvenile Dependency in Ohio

refiling of a case more than once

I am involved in a child abuse/neglect/and dependency case in Stark County Ohio. The legal department for the Department of Job and Family Services has refiled an old set of allegations and added new allegations to make the allegations look favorable to the judge to grant the Department custody. I was wondering if the legal department could refile again before the 90th day because of my children's psychological evaluations not being completed? My children are in complete control of the Department of Job and Family Services and the foster care system.

Re: refiling of a case more than once

At or after the 90th day, the case can be dismissed and the Department of Job and Family Services can refile. In fact, they frequently refile immediately after the case is dismissed. This practice is very common as the court system is often unable to resolve the case within the 90 days granted by law.
