Failed to take USA
Dear Sir,
I am an computer science enginnering graduate from tamilnadu, india. A private consultance which has it's base at USA had promised me to offer a job as programmer analyst with the annual compensation of $44,000/-. I had paid Rs.50,000/- as H1-B Visa obtaining fee to the company. During the end of Dec'2000, The company had given me the H1-B Visa and appointment letter. It asked me to wait for 3 months as the situation for IT in USA is not good. Till to day the company has not taken me to USA,teling the same reason. They also didn't respond to my emails, phone calls.
My visa is going to expire on Oct 2003. I have decided to take up this action legally. Hence, I kindly request you valuable advice in this matter.

Did you get the H-1B Visa from the company or had it stamped with the U.S Consulate here? You are not clear on that. Please state correctly if the company had obtained H-1B Visa from U.S for you and you then had it stamped with the U.S Consulate or if the company had only given a letter supporting your application for H-1B Visa? You are also saying that the H-1B Visa will expire in Oct 2003.
Please clarify for me to advise you.
