Legal Question in Employment Law in Ohio

How can this be leagle

After 22yrs as a nurses aide in the same facility some of the others longer, are finding we are training our own replacements. They are hiring in at a higher wage than me that has been there 22yrs. They hire 11 or 12 we train them then they fire about half that many of the older ones that have been there a long time. Is this legal? I'm scared for my job. Thank you Brenda

Re: How can this be leagle

If the employer's conduct is due to/motivated by age differences, particularly if the veterans are over 40 years of age and the "replacements" are under 40 years of age, then no, its conduct is not legal. Even if the employer lacks a specific intent to discriminate based on age, its conduct may be still problematic if it disproportionately adversely impacts the over-40 crowd relative to the under-40 crowd.

If you wish to discuss this in greater detail, feel free to give me a call (216-687-1244, ext. 701).
