Re: Mileage Rates

When you say we receive 8 cents per mile, it is not clear whether you mean that you are reimbursed for milage at 8 cents per mile (plus receive an hourly wage) or that you are only paid 8 cents per mile for time spent traveling. If you are paid your wage plus receive milage reimbursement at 8 cents, there is no problem. Though the IRS allowance for milage is much higher, employers are not required to reimburse employees for milage. If you itemize, you can deduct the difference between the IRS rate and your employers reimbursement as an employee expense on your 1040.

If, however, you mean that you are paid a total of 8 cents a mile, then there could be a problem depending on whether it results in your being paid less than minimum wage. You will need to do the calculation to figure out the hourly wage that it translates to. If its less than minimum wage, then the employer is in violation of the law.
