minors in the workplace

Our son, 16 years old recently started his first job, at a local chain store. He informed us, that they allowed him to sell cigarettes, at his checkout. I would like to know, since it is illegal for anyone under 18 to possess, or to buy cigarettes, here in Ohio, if it is legal, for a 16 year old to be required to sell them?

Although I have no caselaw on the subject to offer you, I expect that the cigarette sales work the same way that alcohol sales work.

A person who is not old enough to buy a product is also prohibited from selling a product. Fortunately, your child will probably not be held personally liable and, instead, the store assumes the liaiblity.

Certainly, though, this is a bad situation for your son to be in. Good luck!
