Legal Question in Employment Law in Ohio

ORC 4113.15 Semimonthly payment of wages

I work for an Ohio LLC. Currently,

the company pays employees once

monthly on the first of the month

for wages earned from the 16 to

the 15th of the previous month (i.e.

wages earned 1/16 - 2/15 are paid

on 2/27). My understanding of

Ohio Revised Code 4113.15

indicates that semimonthly

payments are required. Is this

correct? Is the current practice in

violation of the law? What should

be my next steps?

Re: ORC 4113.15 Semimonthly payment of wages

I think that your employer is probably in compliance with ORC 4113.15. That section requires them to pay you for the first 15 days of any month no later than the the first day of the next month. Additionally, it requires your employer to pay you for the last half of any month by the 15th of the next month. If I understand your question correctly, your employer is in compliance with that schedule.

If you still believe that they are not in compliance, you should contact a local attorney with a good reputation in your community.
