Legal Question in Employment Law in Ohio
Our son made a mistake at work on a friday, for which he was fired on the next tuesday. However, the day before he was fired, he was asked to sign a non-compete for a period of one year. He lives in Ohio, is that enforceable since they knew they would be letting him go the next day? He worked for a small family owned gun shop, and left some guns unlocked in a cabinet outside. He knows he made the mistake, and that it could have been tragic if someone would have taken the guns. The non-compete is not for a geographic area, it just says he can't work for anyone who is a direct competitor. The company manufacturers, sells, buys and trades all types of ordinance. Thanks!

This will depend on the specific language of the non-compete agreement. In Ohio, these agreements are generally enforceable, but need to be reasonably limited in scope (what you can and cannot do at another job), geographical area, and time. I would need to see the specific text to get you an answer. Depending on the location of the company, the wording of the agreement, and the location where the agreement was agreed to, this could be governed by Ohio or Kentucky law. I cannot give you any general advice about Kentucky law. You should contact an attorney in your area to discuss this in depth.
