After five years with the same company, I as a black man asked my boss, my general manager and the owner of the company to interview me if any assistant management positions come available. They said they would. Weeks later my assistant manager quit leaving a position available. The company interviewed several candidates but never even gave me the opportunity to interview despite five years with the company and a flawless personnel record. They brought in white manager whom had less time with the company than myself. By not even offering to interview me after saying they would if a position came open, is that descrimination.

Possibly, but not necessarily. If the employer had a legitimate, non-discriminatory reason for its decision, then its decision would not be considered discriminatory. Even if the employer has such a reason, however, if it can be shown that the reason stated is false (i.e., not the real reason) or that the decision was actually based on discriminatory intent, then the employer�s decision may constitute discrimination. As many factors are involved in the analysis, additional information is needed to determine whether the employer has discriminated against you.
