Legal Question in Landlord & Tenant Law in Ohio

I need help

My brother recently went to jail. He would like me to get his personal items out of his apartment. He lives in an upstairs apartment. His ex has acess to the key to the ''common door'' downstairs and I have the keys to the upstairs door. We have talked and agreed that we will go in together to get her items as well as my brothers. The problem is that the landlord is denying us entry. I have told her that we all can meet together at one time and she can go in first to note any ''damage'' she claims has been done to the property, but she is refusing. She wants me to relinquish they keys to her so she can go on her own to inspect the premises and THEN call me to make arrangements to get into the home. I feel that she will not do as she is saying. I believe that we have the right to go in on our own to get the items and leave the key in the mailbox for her. I'm not looking for any trouble from anyone, I just want to get my brothers belongings and the landlord definitely seems like she may have alterior motives. What can I do and how do I go about it?

Re: I need help

There are a couple of options that pop into my head. For either of these I would suggest you retain an attorney.

First, get your brother to sign an agreement which give you and the girlfriend access to the apartment to get the items. Then give this to the landlord to see what occurs.

Second, have an attorney contact the landlord to see if something can be worked out. It is likely that the landlord simply wants the stuff out of there. However, you need to protect your brother's property.

I would be glad to assist you with this situation. Feel free to contact me for a free consultation.
