Legal Question in Landlord & Tenant Law in Ohio
my daughter signed a lease on an apt. yesterday. Last night after she got off work she went to the new apt. and when she turned on the lights she saw some bugs (cockroaches). Since the lease was not even signed 24 hours ago, and she has not moved one thing in, is she able to back out of it and get her money back?

It is not likely. I or another attorney would have to review the lease to make sure. She may, however, move out for health and safety reasons if she gives the landlord a proper 30-day notice and the landlord does not remedy the situation. I can draft a 30-day notice and review her contract for you for a very small fee. Otherwise, you may wish to contact another attorney. If a 30-day notice is given, the tenant must remain current in rent until the date of moving out. Your daughter has other options, too, besides moving out.
