In Ohio, an eviction process of a residential tenant must go through the process outlined in Ohio Revised Code Section 1923.04, with a three day notice to vacate being posted on the door, the filing of the F.E.D. action, a hearing before the court, a decision for possession in the favor of the landlord, and a Writ of Restitution issued from the court.
Your argument would be that despite what the lease agreement says about no pets, that the landlord verbally told you that pets would be okay and accepted rent on a regular basis knowing full well about the pet, thereby constituting a waiver of strict compliance with the no pets clause of the lease.
