Legal Question in Landlord & Tenant Law in Ohio

I live in Columbus, Ohio. My roommate is not paying rent and I would like to evict him. We moved into our duplex in May of 2014. Toward the end of our lease he expressed that he would like to move out and back to CA. As a result, I renewed the lease on the duplex in my name only. After that, my roommate changed his mind about moving and asked if he could stay. I agreed and thought nothing of it. Through a series of events he ended up in rehab and lost his job. He has since secured new employment but has not paid rent, since the lease renewal back in May of this year (2015). I've discussed this with him multiple times and he consistently says he'll pay me - but it never happens. Recently, I tried talking to him about it and he became physical. Later that day I caught him stealing money from my wallet. Clearly he has a problem - but how do I get him out of my house?

In Ohio, since the roommate did not sign the new lease agreement and was to pay you instead of the landlord, then he would be seen as your subtenant. That means that you qualify as a "landlord" under Ohio's Landlord/Tenant Act of 1974 as regards him. This means you can evict him if he is not paying the rent on time.
