Legal Question in Landlord & Tenant Law in Ohio
I live in ohio. My landlord improperly kept my security deposit. I wish to sue her in small claims court, but court personnel tell me that since her income is social secutity, which can't be garnished. That even if I win, I have no way to collect except filing for a lein on her property. Can I have her rental income garnished? She owns a duplex and rents one unit.

In Ohio, there are several ways to collect upon a debt beyond garnishment of monthly income. If you get a judgment against the landlord, you can certify the judgment and then take it over to the County Recorder's office and have it attach as a lien on any real estate she owns in the county. Further, if you find out where the landlord banks, you can get a bank garnishment if she is depositing the rental checks into an account.
