Legal Question in Landlord & Tenant Law in Ohio

My mom took in a young girl that was kicked out when she hit the age of 18. This girl has metal health issue and now has threaten my mom and attacked my daughter who is also 18. We called the cops to have her removed from the house and they said we can't do that without evicting her and paying $200 to do so. This girl only gets little to no mail, pays no bills and has no contract with my mom to live there. The officer claims that she has built resident there and we can't do anything not even lock the door. How can I protect my mom and daughter from this girl if we can't kick her out? She only been there for 4 to 5 months.

In Ohio, the law may well presume this arrangement to be a month to month tenancy which may only be terminated under Ohio Revised Code Section 5321.17. But if she is being violent, you can ask the court for a CPO which will require her to vacate and stay away from you. You could also go to the local prosecutor and give them evidence of the assault. That way they could charge her with domestic violence and that would likely involve the court issuing a stay away order as a condition of bond.
