In Ohio, you can only be evicted from an apartment if you breach the terms and conditions of the lease agreement. Most leases do not have a clause in them requiring the tenant to occupy the premises for a certain period of time, but it is possible that there may be such a clause in your contract. So long as the rent is paid and the other conditions of the lease are met, this would likely be a defense to the eviciton action.
