Legal Question in Landlord & Tenant Law in Ohio
I paid my rent when it was due.then a couple of weeks later the landlord said they lost my rent check and now I'm being charged a late fee. and being threatened with eviction if I don't pay the late fee. their lawyer said because I didn't receive a receipt I'm liable. The office manager has admitted verbally that she accepted my rent check and that she mailed and that it was lost in the mail. so can I be held liable?

In Ohio, it will get down to a matter of proof. If you can show the court evidence that you paid on time and your evidence is better than their evidence that you paid late, then you will prevail and you will not owe a late fee. The trouble is that if they lie and say that they got your rent late, then out you go and you have an eviction on your record and you will have a hard time finding a new landlord to take a chance on you.
