I received a 3 day notice to leave my apartment after being late just 1 day. My lease states that the rent must be ten days late before I am in breach of the contract. Is this legal

In Ohio, the landlord must post a valid three day notice to vacate upon the door of the property if he wants to file an eviction against the tenant. Since you were not in breach at the time that the three day notice was posted, if the landlord were to file an eviction, you would have a pretty good defense against that action.
Many landlords post three day notices just to scare the tenants into paying. You should call the landlord, remind him that your lease says you have ten days to pay, and ask him if he will accept the rent. Then follow that phone call up with a letter (keeping a photocopy of it) in which you confirm the contents of the phone call you had with him.
