Legal Question in Medical Malpractice in Ohio
My 17 year old daughter was given medication by a doctor who KNEW that I was the custodial parent. These were mood altering drugs (Klonapin, celexa) that got her in a lot of trouble at school and she ended up being suspended from this past March 25, 2010 to the end of the past school year and now she is under Probation. This has really screwed up her life and made mine a nightmare as well. Had the physician told me she was going to be given the drugs, none of this would of happened. Her mother took her to another doctor and got this done, however like I previously stated they KNEW I was the custodial parent and did not notify me. Basically the physician and her mother pitched her two bottles of mood altering drugs and said "there you go"!!!! Would like to find an attorney that would be interested in legal action against that physician.

Legal action against the doctor may not get you anywhere especially if your daughter actually needed these drugs for psychological issues. Depending on what other facts are out there regarding what this doctor did, there may be something. But from what you've stated above, it doesn't sound like a strong medmal case.
I understand your frustration that your daughter's mother did this without you being notified. Are you divorced from your daughter's mother? Or never married? Depending on your relationship with her, you may be able to take legal action against her.
