Legal Question in Medical Malpractice in Ohio

Do we have a case? Where do we file? FL or OH?

My husband injured his groin muscle and testicle seriously. Since we were away from home we went to the nearest ER in OH. There they performed an xray to rule out pubic bone breakage and an ultrasound of the testicle to rule out damage to the testicle. None were found, they dicharged him with painkillers. The pain had gotten worse over the next few days so he went to another ER in KY. He was told there to get home to see a specialist, there was nothing that could be done. We did. As it turns out the ultrasound was done on his groin area and not his testicle. A 2nd ultrasound was performed here in FL and it was dicovered that there was a repairable tear that bled causing swelling and pain. It was only repairable immediately after the injury occured. He now has a dead testicle and the pain should stop in a few weeks. In the mean time he can't work. Is this a case? And how do we find a good lawyer? We are moving from FL in about 1 month to either Arkansas or Missouri? If a case, where do we file?

If the ER physician is determined to be negligent, then, yes, you have a case. It would have to be filed in Ohio since that is where it happened. If you would like to email me, we could discuss it further.

If the ER Dr. is found to be negligent there is a case. Because it occurred in Ohio, that is where you would have to file the case, particularly in that county.

You need to get a report from your Dr. in Florida stating what the Ohio Dr. did wrong and why he feels the Dr. is negligent.
