Legal Question in Medical Malpractice in Ohio

Concealed penis in infant

Hello. My son is 6 months old. He has a concealed penis. I have reviewed literature and it mainly occurs in circumcisions that were performed poorly. I had no idea the procedure was so risky and now he will have to have surgery to fix it.Is the doctor liabile? Or did I consent and allow this to happen to him?

The problem with your child's penis could well be the result of negligence by the physician. While you may have consented to the circumcision, you did not consent to negligence. A consultation with an attorney would be appropriate.

Your research is most likely correct. Your consent to the procedure is on the basis that the doctor is not negligent. There are risks associated with any medical procedure and you are entitled to have the risks explained to you before you sign the consent form. Your consent must be "informed consent." I am sure that the doctor did not inform you that one of the risks of the procedure was that he or she would fail to follow proper procedure!
