Legal Question in Medical Malpractice in Ohio
The gynecologist i have been seeing had diagnosed me with a cyst on my ovary back in august 2010. He told me it would resolve on its own. I have been in pain and constantly going in for appointments to see if that was the cause of the pain. I constantly had to get pregnancy tests done cause it had caused a lot of pregnancy like symptoms. I had suffered with this pain and discomfort for over 5 months with seeing this doctor at least once a month until i went to the ER for severe pain. They had done an ultrasound and a cat scan and the radiologist said that it was too big (5 3/4 centimeters) and needed to have something done about it. i scheduled another appointment with this doctor and he still did not order any tests and said again it will go away on its own. I finally went to see another gynecologist and got a second opinion and he right away took care of it by doing a laproscopy to remove the cyst and said if he would have let it go it could have flipped my ovary and caused severe damage. my question is; is this enough grounds for a suit in malpractice?

While you certainly seem to be a victim of medical negligence it does not sound like the damages you sustained are severe enough to file a malpractice action. The cost of the litigation would outweigh your recovery.
While I am very sympathic to what you have gone through I would agree with Mr. Fisher's thoughts.
