Legal Question in Medical Malpractice in Ohio

incomplete surgery

I just found out that my previous gynocologist only removed 1/2 of my uterus during my hysterectomy and left everything else. I still suffer from the pain that the hysterectomy was suppose to cure and now to find out that what he did was not even a hysterectomy I am still bleeding and I went through surgery, hospitalization and recovery for a procedure he didn't complete...do I have any recourse?

You may have some legal remedy against the doctor. Medical malpractice claims are difficult to prove, and involve factual issues such as, what did the doctor tell you, verbally and in writing, prior to the surgery; what do your medical records show; and is your current situation an expected one, given your prior medical history?

A legal opinion can only be given after a review of your medical records, other factual investigation, and possibly review by a medical expert. You only have one year to file a lawsuit, usually from the time of the injury, but sometimes from the time you discover you have been injured.

You need to obtain all of your medical records regarding your surgery, pre-op, post-op and everything in between. Also, what did the Dr. inform you of regarding the procedure? You have one year from the date of discovery that something was done wrong to file a claim in court, after that all rights are lost.
