Auto accident, multiple surgeries other person cited
Close to eight months ago my husband was involved in a very serious auto accident where the other party was cited for failure to yield. He has since lost a very lucrative position due to his inability to relocate, had five surgeries, has undergone very painful PT and been in constant pain. He use to be a very avid runner and very physical, he is now never going to be able to return to that lifestyle. My concern is it seems that he is getting the run around from his attorney. I read an article that says that when an attorney says that you have to be healed before progressing with a lawsuit that it is a sign that you should get another attorney. My husband has over $300k in medical bills and the collectors are calling constantly. Are there attorneys out there that give second opinions? I just feel like this attorney is along for the ride and the free money from a settlement. The only person we know this attorney has talked to is the adjuster, why should he make all this money if he is just going after what the insurance company is going to offer.

My first suggestion would be to set up a meeting with your attorney and discuss all of your concerns with him or her. There are a lot of factors that are considered when deciding whether or not to file a lawsuit and when to file it. After you have the meeting if you are still not satisfied with the reasoning, you can always retain a different attorney to represent you.

You are always permitted to request a second opinion from an attorney. What is not permitted is for another attorney to actually accept your case and represent you and your husband unless you have released the prior attorney from the case.
There are other ethical considerations for an attorney who is questioned about a case when there is already on attorney on the job. You should be able to get additional information within the ethical guidelines.
