Legal Question in Personal Injury in Ohio
breach of contract
my 74 year old mother was injured at a hobby lobby about a year ago, and sustained shoulder and arm injuries caused by an unsecured microwave cart rolling off a top shelf and knocking her to the ground. trying to make a long story short, her lawyer advised her to settle with the first offer and became angry with her for not wanting to except and told her she could be arrested, which terrified her. is this true? desperate for an answer. thank you!

Re: breach of contract
With the small amount of information on your post, I doubt she can be arrested. Some attorneys like to settle quickly. Wish I knew more of your story...

Re: breach of contract
In Ohio the failure to accept the a settlement offer is not a crime. From the limited information provided, I can tell you that what is concerning is the ethical conduct of the attorney, if in Ohio, in terms of threatening your mom that she could be arrested. Such conduct is a violation of the Rules of Professional Conduct. From the information provided I would tell your mom that she is not being properly represented and is not at risk of being arrested.
