Legal Question in Personal Injury in Ohio

Want to change attorneys

My husband retained an attorney for his motorcycle accident in Sept 2003. The attorney never does what he says he will do (i.e. ''I'll file the suit today'' and a month goes by and he hasn't done a thing). We want to switch attorneys but he threatened me that if we switch he will be awarded a portion of any proceeds we receive. Is this true? We retained him on a pro-bono basis, and a $6000 settlement was offerred that we declined. How can he be awarded any money when he has been completely unsatisfactory as our representation? We want to be represented by a lawyer that will take our case seriously and move forward since a year has passed already.

Any advice would be greatly appreciated.

Re: Want to change attorneys

The first attorney may think he could sue you for his work, but your response would be that he failed to work the case enough...Very seldom do attorneys attempt to sue their clients because that exposes them to a malpractice case. My guess is that he is simply threatening you to keep as a client, which is sad.

I'll be glad to talk to you.
