Legal Question in Personal Injury in Ohio

Check endorsement of an insurance check that is for a partial payment only.

A friends daughter was recenlty killed in an auto accident in which she was a passenger. She recently received a check from the insurance company for medical/burial expenses. How does she endorse this check without acknowledging this is a payment in full?

If you read the check, it will probably say for payment under the medical payments coverage of the policy. If it has any language such as for payment in full or release, don't sign it. I'd need to know exactly what the check says to let you know if there is any other problem. Contact my offices and I'll be happy to further advise you. Our Ohio number is 440-233-1114 or if you'd like to send me your phone number directly to my email address ([email protected]), I'll give you a call.

With something of this magnatude, I would have an attorney review the documentation to make sure that all of the parents rights are protected. I would be glad to help. If they want to contact me they can call me at 330-762-1199.

It is impossible to answer the question without more information. YOUR FRIEND NEEDS TO HAVE AN EXPERIENCED ATTORNEY REVIEW THE CASE. Most insurance companies are not going to pull a "fast one," but legal counsel is a must for a wrongful death case.
