consequences of driver and owner

There was an accident. The car was not insured, the plates were experied. The driver was hit by a tractor trailer and seriously injured. What are the consequences for the driver who had no permission to drive car? What are the consequences for the owner?

If I understand correctly, the state of Ohio will suspend the license of both the owner and driver. That does not stop either from claiming damage to the vehicle or for pers. inj.
