how does the court view injury compensation when seat belt not properly worn?

When a person is cited for causing an automobile accident and is later sued for compensation for pain and suffering experienced by a child passenger because of these injuries, does the judge concider that the injuries wouldn't have been as extensive had the child been properly restrained in his car seat?

Yes, the concept of comparative fault comes into play. there are also statutes that specifically state that the Court can take this information into consideration.
