Legal Question in Personal Injury in Ohio

I have custody of my granddaughter and my ex daughter in law comes for visits 2 days a week. I just recently found out, she was hiding a tape recorder in her purse and then she would go outside (weather permitting) with my grand daughter for hours and have the tape recorder running. Is this eavesdropping? She tape personal conversation's between myself and my husband, and other of my family members without our consent.

Depending on how the tape recording was performed, it could be illegal. In Ohio you can tape record conversations that you are a part of, but you generally cannot record other people's conversations if you are not in them and you do not have someone in that conversation's consent. There are exceptions to this, and without knowing more, I cannot tell you for sure whether your ex daughter's conduct was illegal.

If she left her tape recorder in the house when she was not in the house, and recorder your conversations that she was not a part of, it may very well be illegal. You should contact a lawyer and the police in your area to see what you can do.

However, I wonder how you found out the tape recorder was present in her purse. Make sure you haven't violated any laws before you report her because she may retaliate by reporting you. People in glass houses...
