Daughter being sued by boyfriend

My daughter was driving with her boyfriend in the car and they were in an accident. They both had some injuries - we thought it was nothing major. Now almost 3 months later we get mail saying he is suing her. This is the problem - they are still dating, he didn't tell her of his intentions. Should she stay away from him until this is settled?
