That depends. If the vehicle was on an emergency run, it is probably immune from a suit to recover damages. If it was just driving on a non-emergency trip, there could be a recovery.

In general, the threshold for establishing liability is significantly higher when you�re suing the government than what is required in a typical accident case involving a private individual or company. (I'm assuming here that the emergency vehicle you're referring to was not privately owned.)

And cases involving emergency vehicles are even more difficult. In real emergencies, the government is generally given wide latitude to respond. If the vehicle did not have its lights and siren on, and was not responding to an emergency call, or the driver was in some way impaired, your chances of recovery are likely greater than if the accident occurred during a normal emergency run.
