Legal Question in Personal Injury in Ohio

emotional distress?

I have discovered that my ex's stepson was the victim of sexual abuse. Because of different things that I have been told and different lies I have discovered that my ex has told me regarding this situation, I suspect that it was at the hand of the older stepson, with whom my son shared a room with for years. Because of my concern, I have shared with my ex and his wife what I suspect and have asked them for details regarding this situation so I can determine for myself if my son was exposed to the abuser. They are refusing to give me any information and tell me that who abused the stepson is none of my business. I have asked them multiple times for the name of the abuser and am in the process of asking a judge to compel them to give me (I am the full custodial parent of MY son) the information I am seeking. Now, my ex's wife is threatening to sue me because this situation has caused her emotional distress and for suspecting her son victimized her other son. I have only shared my suspicions with my ex and his wife. Does she have grounds for this?

Re: emotional distress?

I'd be surprised to see any lawyer willing to take a claim for emotional distress alone. Such a claim could be theoretically possible, depending on what state this happened in, but again it would seem unlikely to me that any lawyer would take such a case.

I suggest you be in close contact with the child protective agency in the state where you live on this entire issue, and consult with a lawyer EXPERIENCED in family law as well. Sorry I can't be more definitive in my answer to you, but I think you really should be talking to a family lawyer. Good luck! Let's hope nothing happened with your son in the first place. -- Sam
