Legal Question in Personal Injury in Ohio

What should I expect to recieve in settlement?

I was in a car accident about six months ago, a semi rear- ended my car. I had neck injuries, a concussion, and constant headaches for close to 5 months. My health bills total around $6,000. What can I expect to recieve as a monetary settlement for pain and suffering?

Re: What should I expect to recieve in settlement?

There is no formula to determine the amount of compensation for pain and suffering. It depends on each individual's circumstances. For example, did the headaches prevent you from doing things you usually do? Did your injuries affect your ability to do your job or to do household chores? Did you take a large amount of a pain medication which resulted in irritation to your stomach? How did the injuries affect your relationships? These are some of the things to be considered and it is not really possible for me to give you an evaluation as to the amount of settlement without more information and a review of your medical records and bills.

Melissa is correct. Also, generally speaking, you will not get anywhere near the true value of the case without an attorney to negotiate the matter. Without an attorney involved, the threat of suit isn't hanging over them, and the money offered will be less. At least consult with a personal injury attorney in your area to get a better understanding of the process. Call with any questions. 859-491-5800.

Re: What should I expect to recieve in settlement?

Generally, most personal injury attorney's expect 3-5 times the amount of medical bills plus dollar for dollar for lost work and other losses.

You're looking at 20-30,000 settlement - and this is only an estimate used by the agents who will settle the case for the insurance company once they know you're represented.

If they know you're not represented, you will probably not be offered that amount. You need to at least consult with an attorney directly.
