I need to know what is fair compensation for an accident related injury
I was injured in an auto accident about a month ago. It was on a freeway, another driver lost control and hit the wall, spinning and hitting me. My car was totaled. I could not walk for 5 days, could not work (I'm self employed thus I do not have sick time), still have minor pain that the doctor states will go away in time, and I am now afraid to drive. I am in fear of losing my work contract since I could not work and had to take unscheduled time off. Another provider must now be found for ''back-up.'' Since I am afraid to drive as much as I did before the accident, my job could be in jeoprady. Is there any compensation that can help me? I work with an autistic young man who was with me in the accident. If I am unwilling or unable to drive during my job, I will lose it.

It is difficult to provide a value for your claim without more information. The value of what is considered fair compensation is based upon the medical expenses incurred, the nature of your physical injuries, the length of disability, the time that you continue to experience pain and suffering and a loss of normal enjoyment of life, as well as past and future earnings. From what you describe it is too early to place a fair value on your claim and I would suggest that you seek a second opinion on your injuries from another doctor and consult with an attorney in your local area as it is dangerous handling your claim without competent representation if your condition becomes chronic or longstanding. The insurance company is out to pay you as little as possible for your injuries and will likely be very nice to you to avoid your hiring an attorney but I suggest you consult with a local attorney sooner than later based upon what you have described. good luck.

You may be compensated for your lost wages, but you must get a Dr.'s excuse to satisfy the insurance company. Also, you may be able to get compensation for fear of driving, but you probably need to get a counselor (psychiatrist or psychologist) to back up your claim. Insur. companies do not just hand out money to claimants because they are inconvienced. In fact, they assume that nobody is hurt and make you prove (usually in court) that you are the exception. You probably will need a lawyer to get fairly compensated.
