Legal Question in Personal Injury in Ohio

My family was involved in a car accident where a guy crossed a double yellow line to cut in front of us and slam on the brakes. We hit him in the rear and the police gave my spouse a ticket for not leaving enough space between cars. We went to court for the ticket and won and the judge said, not only was my spouse not guilty but the guy took away his ability to leave enough space. Now the guy and his insurance company have gotten a lawyer and sued my spouse for his vehicle damages. We tried to get his insurance to pay us but they said that just because we are not guilty does not mean that it is their clients fault and they won't pay. We don't have money for a lawyer. What should we do?

You need to turn the matter over to your insurance company. That's why you have insurance. If you are not at fault your insurance company will hire and pay for a lawyer to defend you. In the event you lose the case your insurance company will pay the judgement against you.
