Head on collison
My car,with my family inside, was involved in a head on collison. The man who caused the accident does have insurance. (He was not intoxicated) My daughter and I were slightly injured: Major seatbelt-airbag soreness as well as lower back soreness. We were taken to the hospital, checked over, many xrays and determined all injuries were minor. (My daughter missed several days of waitressing because of her back. (This is her summer college money she missed) I know his insurance will want to make a financial settlement for our injuries. What kind of offer do you think they will give me? Do I try to anticipate if my back will be sore years down the line? My husband, who was in the back seat and not injured at all, has been a nervous wreck ever since the accident. He makes me call him everytime I go somewhere. (He is making sure I didn't get into another wreck) Can he file for emotional damage?

First, it is impossible to say how much you are going to recover as the amount is based on the severity and permanency of the injury. As to your husbands claim, unless he gets some psychological treatment, his claim for emotional distress only will be denies. He may be able to get a minimal amount in order to obtain a release from the insurance company.
