Legal Question in Personal Injury in Ohio
Hello,
I asked a previous question in regards to my son's car accident involving a semi-truck. I received some very helpful answers...THANK U! The day of the accident I contacted a couple lawyers and they told me that I should try and handle this myself and if it becomes to much for me then I should contact them. Is this positive advice? I received a call from the truck drivers insurance company, but only to tell me the claim would have to be transfered to another claim adjuster. I would forever be grateful if I could get some idea of a money figure I should be asking for in regards to compensation? I am so afraid I am going to forget all these expenses. I would like to talk with the insurance company before turning this over to a lawyer. I would like to listen to their offer and then contact a lawyer to discuss it. Is this a wise decision? Thank you again!

With out lots more information it is impossible to tell you what your case is worth. I will tell you that you have two years to either settle your case or file a lawsuit. Do not settle your case too early. Please call me to discuss your rights. You absolutely do not have to hire me or pay me anything but I will be glad to take 10 minutes to explain your rights to you. I'd hate to see you taken advantage of.
The amount of compensation your son should receive for his injuries is highly dependent on the nature and permanency of his injuries and the costs of his medical treatment. As you previously indicated that he is still seeking medical treatment for his injuries, you would be wise to avoid settlement until he reaches a point of maximum medical improvement. Only then would you have a better picture of a monetary figure that would fairly compensate him for his pain and suffering.
I agree with the previous answer in that you should avoid rushing to settle the claim - you have two years from the date of the collision in which you can file a lawsuit.
It may sometimes be more beneficial economically to handle a personal injury claim on his or her own if the injuries are minor; however, it is too early to determine the nature and extent of your son's injuries. Insurance companies love to settle early. In line with the other advice above, I would suggest that you wait to attempt to determine the amount of compensation that would be fair and reasonable. On the other hand, the property damage claim can be settled immediately. No one will be able to tell you the amount of compensation that you should seek without reviewing all of the information.
