Kroger negligence
My brother, a clean cut college student was battered and robbed outside a Kroger store last evening. He ran through the parking lot to escape his persuers. He made it as far as the automatic doors. Far enough that when he was brought to the ground he opened the automatic door. There was a clerk who was inside the store who appeared to make eye contact with him as he hollered for help. But the employee didnt come to his help or call for assistance but rather walked away. Needless to say my brother was beated and robbed by the three men. At this point he suffers from severe trauma to his face and back of head. It appears as if surgery will be required to fix his broken nose. If the Kroger security tapes (that the police already have into custody) prove my brothers story, is this a case a negligence by the Kroger employee for his lack of caring and assistance? or even the store for not having proper security? Or just a case of society falling another step from proper living?

There are some factual issues to nail down, but your brother would seem to have a "premises liability" case against Kroger's. They will of course assert the criminal conduct of the assailants, that is, point the finger at the "bad guys", as the causation of the injury. Not an easy case, but it has possibilities.
