Lost wages due to a auto accident
I was involved in a auto accident a few months ago. During that time I have lost about 8 weeks of pay. Does the insurance company owe me the net amount of my lost wages or the gross amount?

When I do demand letters to insurance companies for my clients, I always include the gross amount of lost wages. There is no set rule as to whether the company is supposed to pay the net or gross. The settlement offers of the insurance companies are usually more than the economic losses to compensate for pain, suffering and loss of enjoyment of life, and it is difficult to tell whether the company is considering the gross wage loss or the net wage loss.

Compensation should be on the gross amount. Normally, recovery from personal injury cases are not taxable, but the amount attributable to lost wages is taxable.
