Legal Question in Personal Injury in Ohio
My mother is 75 years old and her life has been enormously impacted by a surgical procedure done 6 weeks ago. It was a thyroidectomy. She had an ultrasound done on it a year before the surgery and then again one month before the surgery and was told there was no change. When the surgeon got inside he found a cyst and a very large thyroid. When I was called back to speak to the surgeon after surgery, he explained what happened during surgery and explained that while he was extracting the cyst, he inadvertently severed her vocal chord. He felt very very bad. He tried to resect it but it wouldn't take. She now chokes on liquids everytime she drinks and this effects her breathing when she speaks. She has no voice. When she tries to speak it comes out as a low growling whisper. You can't understand her. She cant speak to her children or grand children on the phone. She doesn't like to go out anywhere because she coughs and chokes. When she speaks, she has to stop every few words to drawl in a breath. Is there some sort of compensation due to her.

Ohio does not have a 'no-fault' system of compensation for victims of medical negligence (similar to Ohio's Workers Comp system which provides payments for work-place related injuries without having to go through litigation).
