Personal Injury Suit Why Is It Taking So Long?

3 years ago I was injured at a retail store. After all the med tests I had a broken neck, severe concussion & C syndrome, brain damage, neck nerve damage, 3 bulging discs still, severe migraines & syndrome, post stress & dis-association syndrome. NeuroPsychologist test shows I was at 79% of work force before accident, 22% now. Almost totally disabled. The place where I was injured has admitted total fault & they have all these records. I just received a letter from them asking me to go see an independant doctor? What more needs to be done? Court case is set for 1st week of May 2004. Why is this taking so long? Why wont my attorney tell me a ballpark settlement figure?

Settlement of a claim as serious as you describe must, necessarily and out of simple propriety, take sufficient time. It is my guess that you are still experiencing new ramifications of your injuries and finding new pains and limitations. In theory, you want the fullest revelation and resolution of such consequential conditions before you accept a final settlement. An Independent Medical Exam (IME) is standard in such cases. Your attorney should take an active role, perhaps even attending the exam with you. Your attorney's reluctance to mention a figure suggests prudence on his part. Until the results of the IME the other side will not be able to make a significant offer. It would be foolish for you to have unduly high expectations, perhaps getting "married" to a high figure before all the facts necessary are brought to the table. Have confidence in your attorney.
