Legal Question in Personal Injury in Ohio

proper procedure

Can my attorney accept the final amount offered by an insurance company or doesn't the client have to OK the amount?

This is regarding lawsuit against owner of a dog who bit my daughter.

Re: proper procedure

The client would have the final say on whether or not a settlement offer will be accepted. Additionally, if your daughter is a minor, the settlement would have to be approved by the Probate Court also.

Re: proper procedure

Generally speaking, the client controls all major case decisions such as whether to settle, whether to file suit, etc. Therefore, the answer to your question would be that the client must approve of the settlement. A fee agreement may state otherwise, but if it did that would be ethically questionable. Contact me if you would like to follow up on this more.
