Legal Question in Personal Injury in Ohio

Protection of assets in a civil lawsuit

In the event of a civil suit filed against me, what is the best way to protect my assets from being siezed and made a part of the settlement? It appears we may have been underinsured with our automobile insurance. House is paid for and we are anticipating retiring within the next 2 years. Your input is appreciated.

Re: Protection of assets in a civil lawsuit

Any attempt to transfer your assets will probably be subject to a claim for fraudulent transfer. Once you are aware that there may be a potential claim against you, you can not transfer assets to avoid payment of the claim. The person injured in the motor vehicle accident may have underinsured motorist coverage to compensate him or her. If you are concerned about a judgment against you that you may have to pay, I would advise you to seek your own attorney to represent you in addition to the attorney that the insurance company would appoint for you.
