Legal Question in Personal Injury in Ohio

Was rear-ended in an auto accident in the state of Ohio on 9/08/2010. ZERO fault. suffered soft tissue back injury and torn meniscus in knee. Total medical bills are $13,802.38 with $2,819.56 not covered by health insurance. The insured motorist carries Allstate Insurance. Would a fair settlement be in the range of $17,000 - $20,000 above and beyond all medical expenses? and not including health insurance reimbursement, assuming Allstate would adjust that directly? Any information would be greatly appreciated.

Thank you,

Thomas Kelley

In the last few years I've resolved 3 or 4 arthroscopic knee cases for between 30 and 50K. Be advised that you are dealing with the most difficult to deal with insurance company in North America (based on my experience). Don't be surprised if they offer you $5000.00 or even less. Without counsel you really have very little leverage when it comes to negotiations. The only way to get Allstate's attention is through a lawsuit and jury trial.
